Law reform policies (recommendations)



"This book contains the findings of studies on and recommendations for law reform in Indonesia. Since 2000, the National Law Commission has been engaged in the process of conducting studies and formulating these recommendations in collaboration with a number of working groups from various parts of Indonesia. The studies were conducted based on fourteen specific work programs categorized in to four key areas, namely, the executive, legislature, legal system and legal profession. The studies involved the colection of data and the procession of sugesstions, advice and criticism received from all levels of society, with the primary consideration at all times being the need for the principles of good governance to be upheld. Thus, it is safe to say that these studies were truly based on a bottom-up approach, rather than the top-down approach that has been tradionally applied in Indonesia.
The studies and recommendations concerning the legislative field cover the National Legislation Program and its relationsip with the effort to bring about law reform, the recruitment of the judges of the Anticorruption Court, the role of the government's legal bureaus, the role of research institutes and institutes of higer education in the farming of legislation, access to legal information,the handling of complaints regarding the services provided by public bodies, protecting the public from malpractice on the part of the different professions involved in the legal system and the role played by the government in the natin's economy. With regard to the legal system, the topics dealt with were the problems that have arisen to date in connection with some of the decisions that have been handed down by commercial court, access to justice, court administrations, judicial recruitment, and supervision and oversight in respect of the integratedcriminal justice system. As regards the legislative field, the areas covered were public access to and transparency in the legislative agenda, public hearings in the house of representatves, the role of research institutes and institutes of higher education in the framing of legislation, and the priorities set by the National Legislation Program. Finnaly, in the case of the legal professions, the topics covered were the role of professionals working in the legal system in supporting the working of the system, legal education, examination in the legal professions, and professional dicipline."
